- Dear customer, Thank you for choosing Netlink products. To make you more satisfied with our services, kindly read the following instructions carefully before selecting an AMC plan. The terms “We” / “Us” / “Our”/”Company” individually and collectively refer to Netlink ICT Pvt Ltd and the terms “You” /”Your” / “Yourself” refer to the users.
- Privacy Policy : This privacy policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder and the amended provisions pertaining to electronic documents/records in various statutes as amended by the Information Technology Act, 2000. This privacy policy does not require any physical, electronic, or digital signature. This privacy policy is a legally binding document between you and Netlink ICT Pvt.Ltd . The terms of this privacy policy will be effective upon your acceptance of the same (directly or indirectly in electronic form), by clicking on the I accept or by use of the website or by other means) and will govern the relationship between you and Netlink ICT Pvt.Ltd for your use of the application .
- Company agrees to provide customers with the services on the terms and conditions of this contract.
- This policy applies to OLT, EDFA and Splicing machines and services offered by Netlink. If you have any queries about the AMC policies, please feel free to contact us through our website or write to us.
- AMC works through an application on the Android system. In addition to the application guidelines, the FAQ option for resolving customer queries are also available. Customers who do not know how to use the mobile application can contact the AMC executives directly.
- Anyone who is using warranted products of Netlink can avail the AMC facility through the AMC mobile application.
- Operators can avail AMC services only for OLT, Splicing machine and EDFA products. At the time of payment, the operator will get a discount based on the received points for adding ONT’s which will get converted as cash.
- The customer will be able to add an ONT device’s MAC address in the AMC application, only through barcode/QR code scanning. However, in case of ERROR during scanning, the MAC address can be sent to the AMC Department and can be added through the AMC software.
- The services available for each product will vary according to the category and product model given above.The cost of sending the product to the establishment for repairs must be paid by the customer. At the same time, the cost of returning the product to the customer will be borne by the service provider.(The Mac address of each ONT device is barcoded and numbered on the bottom side of the device).
- Period of contract : The contract is valid from the date of signing(from 00:00 hours-23:59hours-even a second after this will be counted as the next day) of memorandum of understanding(MOU)on AMC. This may be renewed through AMC’s available plans for satisfactory service & fulfilling the terms & conditions.
- Purchase duration : Customers can opt for the AMC after the completion of free services.
- AMC plans : Users can opt for AMC for a period of one year or for a period of 6 months only. In addition, a ONE-TIME SUPPORT option is also available for those who do not wish to take AMC service.
- Customers who have not booked a single ticket in the software or hardware will get a 25% discount on next year’s AMC payment. Its grace period will be one month. AMC renewals taken for six months or one year will have a grace period of one month. If the AMC is renewed after this one month period, the above NO-CLAIM BONUS will not be available.
- Company reserves the right to revise the charges, price list, and service packages for the service from time to time at its discretion, which will be binding on the customer.
- Company shall not be liable to refund any amount to the customer, when the service is down or suspended.
- The services available for each product will vary according to the category and the product model.
- The contract shall not cover any replacement of accessories of the product.
- The company would not provide AMC if the failure occurs in the process of using our product in following cases; *Assemble/disassemble inappropriately *Modify/repair the product without permission *Abnormal force leads to damage *Damage caused by natural disasters or other in-disciplinary elements
- AMC is only available for a fully functional device. However, for a device that is completely or partially inoperable, AMC may be available after it has been repaired.
- A salty atmosphere causes damage to every electronic board. So when you place devices like OLT, EDFA,ONT/ONU make sure that air is properly conditioned. We recommend placing OLT and EDFA in air-conditioned or in a similar environment to get rid of this salty atmosphere. Any damage caused due to this will not be covered under AMC. AMC shall not cover, if any ONT/ONU placing in a salty atmosphere.
- Netlink will not be responsible for downtime of service due to reasons beyond its control. Events like riots, strikes, epidemics, or any other cause similar to the kind of enumerated or equal force not within the control of Neylink and shall not cover under AMC.
- AMC shall not cover any defects that occur due to usage of non-recommended spares.
- Operators can get an AMC for their own products(if warranty has expired or is going to expire) by entering the details.
- Operator will be notified if the AMC is going to expire through SMS.
- As per our AMC policies, there is not an option for transferring the AMC from the original customer to others.That means the AMC service is reserved for single customer only. If a customer purchases a second-hand OLT (which was under warranty or AMC) and if he wants to avail the same services, he should directly contact the company and the company will arrange for an on-site study of that particular OLT. After verifying the product and installation environment, the company will allow the customer to pay for fresh AMC services . Either he has to register as a new user, or the company has to permit the customer to re-register the AMC under certain circumstances.
- Redeem points will be added to the account based on the number of ONT’s added . At the time of AMC payment, operator will get a discount of that particular amount(earned points will get deducted from the actual amount)
- Users will be able to login to the application by entering their registered mobile number and OTP.
- Operators can avail ONE-TIME SUPPORT (only for products which do not have an AMC) when an operator who already availed the mentioned service, requests for a second service, he has to avail a 6 month or 1 year AMC plan.
- The services available to a customer who opts for one-time support under the AMC plan will be charged on an hourly / daily basis. There will be an option to select this in the application.
- An operator can scan the product using a barcode scanner integrated in the app and can proceed to raise a ticket.
- In cases where the parts required to repair a product are not available within 90 working days, under the Buy-Back policy, the customer can opt to purchase a new product by paying 50% of the current market value of that product.
- Stand-by product : The stand-by product is only available within the AMC period, incase of manufacturing defect.
- Payment term : For all the above mentioned AMC plans, payment will be made through online(AMC application). An AMC can only be paid in advance, after the AMC plan selection. The charges towards service are payable in advance . All taxes, duties or any other levies of any nature whatsoever payable for the service shall be payable by the customer in addition to the charges towards availed services.
- Tariff plans for each service are available in the application and it will be modified or replaced from time to time.
- Support : Free technical support, hardware support, free OLT android application is only availed till the expiry of an AMC selected plan.
- Working hours : It takes about 30 days for a product to repair its damage. This period will depend on the product and technical support policy.
- Under the Indian Contract Act 1872, a party may terminate a contract by giving legal effect to the parties to the contract.If a customer enters into an AMC agreement with a third party who is not a current AMC contractor, that agreement will be VOID without notice.
- If any malpractice has been noted in the application or software, that AMC will immediately get blocked.
- Final authority : The final authority for payments will be the Head of the Organization offering the AMC.
AMC Terms and conditions
These terms and conditions agreement(“Agreement”)is a legal document that explains your rights and obligations as a user of AMC mobile application from Netlink ICT Pvt. Ltd(the “Company”) AMC mobile application is an online service offered by the company. By accessing or using the app, registering an account or accessing or using any content, information, services, features or resources available or enabled via the app(collectively, the “services”) clicking on a button or taking another action to signify your acceptance of this agreement, you agree to be bound by this agreement and any future amendments and additions to this Agreement as published through the services;
- Represent that you have the authority to enter into this agreement personally and, if applicable, on behalf of my company, organization or other legal entity on whose behalf you use the services. Except as provided, if you do not agree to be bound by this agreement, you may not access or use the services.
Definitions: This clause is about some specific words that are used in the context of the terms and conditions.

- Conditions of use: By using this application, you certify that you have read and reviewed the agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this agreement, you are advised to leave the application accordingly, Netlink only grants use and access of this application, its products, and its services to those who have accepted its terms.
- License to use: Subject to your agreement to and compliance with the terms of this agreement, we grant to you a non-exclusive, non-transferable, non-sharable, revocable, limited license to use the services (including the software in connection with the services) solely for your personal, non-commercial use to the services in accordance with this agreement.
- Prohibited conduct: You agree to use the app in accordance with these terms and applicable laws and regulations. You will not violate any applicable law, contract, intellectual property or other third-party right or commit a tort, and you are solely responsible for your conduct while accessing or using the app. In connection with your use of the application and the services, you will not;
- Log into an account which you are not authorized to access; Use or attempts to use another user’s account without authorization from that user and Netlink .
- Use the app in any manner that could negatively affect or inhibit other users from using the app and the services or that could damage or disable the functioning of the app and the services in any manner.
- Develop or use any third-party applications that interact with the app or services without our prior written consent, including any scripts designed to scrape or extract data from the app.
- Term & termination: The term of this agreement(the “Term”) commences on the date(00:00 hours-23:59 hours: calculated as a day), you first indicate your acceptance of these terms, and will continue in effect until otherwise terminated in accordance with this agreement. If you are in breach of any of these terms, we reserve the right, in our sole discretion, to terminate your right to access or use of the app. We are not responsible for any loss, damage or harm related to your inability to access or use the app based on such termination.
- Force Majeure: The company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labour or materials.
- AMC policy: We encourage you to give the AMC policy a careful look because, by using our services, by default you are agreeing to our terms and conditions as well.
- Governing law: By visiting this application, you agree that the laws of the state of India, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort, that might come in between Netlink and you, or its business partners and associates.
- The FAQ will have highly relevant searchable questions with its answers. View and read them for better understanding on AMC renewal, payment and all other features.
- Customer agrees to notify the company immediately of any changes to the information customer had given to the company when registering for the service, including any changes to customer’s contact number and so on.
- Please refer to our AMC policy for further information about what an AMC does and how it functions.
- You acknowledge that, providing false or misleading information or using the items to further fraud or unlawful activity is grounds for immediate termination of these terms.
- Any person availing the AMC, shall be deemed to have accepted these terms & conditions.
- This contract can be terminated with prior notice of one month, in the event of malpractices occur.
- Disclaimer of liability : We will not be held liable for any damages that arise from the use of our app.
- Right to update or modify terms : Netlink reserves the right to edit, modify and change this agreement at any time. We shall let our users know of these changes through electronic mail. This agreement is an understanding between Netlink and the user, and this supersedes and replaces all prior agreements regarding the use of this website. If you were a user before the revision date, it replaces your existing agreement with the company.
- The customer shall at all times follow all the rules and regulations laid down by the competent authorities from time to time.
- Questions, complaints, claims: If you have any questions, complaints or claims with respect to the services, please contact our AMC support department/executives using the contact information available on the services(CONTACT US). We will do our best to address your concerns.
- Netlink will not be responsible for any hardware issues arising due to third party device integration.
- Renewal of the service contract after its expiry will be at the sole discretion of Netlink and depending upon the model/age of the product and usage period.
- Company will put in best efforts and strive to maintain the maximum possible uptime of the service. However, Netlink will not be responsible for action beyond its control. Customer acknowledges and accepts that in the very nature of the service to be provided there can be a number of factors affecting the provision of the service and company’s obligation to provide the service shall be on best endeavor basis.
- Customer/user hereby expressly agrees to abide by all the terms and conditions applicable to AMC application provided in the applicable terms & conditions.
- AMC service is reserved (limited) for one customer only, and it is not allowed to transfer under any circumstances.
- Netlink ICT Pvt.Ltd reserves the right to initiate appropriate legal proceedings in case of breach of any of these terms and conditions by the customer.
